The following displays the terms and conditions which we (Sol Culture) use to supply our products to you, the customer.
We encourage you to please read the following terms carefully as these terms highlight in detail what you need to know when buying with Sol Culture. If upon reading our terms and conditions you think you notice a mistake, please inform us. Our terms and conditions may be revised without notice by posting the updated terms and conditions of sale to our website. Please note, the terms and conditions on the website present at the time of item purchase will indeed govern that purchase.
1 Contact
1.1 How to contact us. You can contact us anytime at solculturehelp@gmail.com
1.2 How we might contact you. If we need to contact you, you will receive an email from us which will be sent to the email address you provided to us in your order.
2 Our products
2.1 What do we, Sol culture, provide? We provide fitness clothing and training attire for both men and women.
2.2 Descriptions of our products. All pictures of our products on our website are solely for illustrative purposes. We try to ensure that the colours of items are displayed accurately on our website, but we can’t guarantee that a device’s display of an item’s colour reflects exactly that of the physical product in person.
3 Placing an order
3.1 Who can place an order? Both adults and minors can place an order for our products provided they clearly understand all terms and conditions
3.2 Who can’t place an order? Individuals with mental incapacity regarding the understanding of our terms and conditions
3.2 Gift cards. You can purchase a gift card (in the form of a digital code) from us in the same way as any of our other products, however:
3.2.1 Gift cards are valid for 2 years from the date purchased
3.2.2 you cannot purchase a gift card using another gift card as payment.
4 Delivery and Shipping
4.1 Delivery costs. All Australia-wide shipping orders will cost $10, all Overseas Shipping orders will Cost $25 and Express Shipping orders Australia-wide will cost $18.
4.2 Additional charges. We will not be responsible for any customs, duties or additional charges which may apply to your orders placed with us (For example, if your order is delivered outside of Australia). Any additional charges will not be included in the delivery costs.
4.3 Delays. The delivery time of your product will be subject to the relevant shipping method chosen, which will be highlighted when purchasing our products. We are not responsible for order delays that lie outside of our control (e.g., postal and/or courier delays, logistical issues, or poor weather conditions etc.).
4.5 If when the product is delivered you are not available or if the products cannot be posted through your letterbox, the postal services/courier will most likely notify you that a delivery attempt has been made and tell you how to rearrange delivery or collection of the product(s). However, please note this may differ slightly based on how the postal services/courier operates in your location of delivery.
5 Our rights to cancel your order
5.1 If we cannot fulfil your order. In the unlikely event that we’re not able to fulfil your order (e.g. the product is out of stock, we haven’t been able to verify the billing information provided or you have requested delivery to a country that we do not currently ship to etc.) we’ll inform you via email and we won’t charge you for the product. Also, In the event that this occurs, no contract will be formed between you and us.
5.2 Uncommon or suspicious activity. Our products are intended for personal use only and we may cancel an order if we have a suspicion that our products are being exploited for any commercial, business or re-sale purposes. If this does happen to you and you think we’ve made a mistake, please don’t hesitate to contact our customer service team through our email – solculturehelp@gmail.com
5.3 Stopping product supply. We may have to suspend the supply of a product to you if we are:
5.3.1 dealing with technical problems/making minor technical changes;
5.3.2 update the products subject to changes in relevant laws/regulatory requirements.
5.3.3 make changes to the product as notified by us
6 The rights you have if you choose to end the contract
6.1 You always have the right to end your contract with us. The rights you have when you end the contract will vary whether there is anything wrong with the product. We are under a legal duty to supply products that comply with this contract.
6.2 If the product you have purchased is damaged or differs significantly from how it is described on our website you could be legally entitled to a replacement or refund of the product.
6.2.1 Return the product to us within 7 days of receiving time after you have had a reasonable opportunity to inspect the products:
6.2.2 have not disposed of, lost or destroyed the goods.
6.3 You will need to pay the cost of the return as a part of our returns process. Please note that some products can’t be returned, such as:
6.3.1 any product which has been worn, damaged, used in any way or has had the product label cut and/or removed;
6.3.2 any product which is missing any part(s) when returned by you (unless this is because of something we have done); and
any products which become mixed inseparably with other items after their delivery. Won’t be refunded.
7 Returns and refunds
7.1 To end the contract with us, email our support team at solculturehelp@gmail.com, and provide the issue that has arisen, and we will get back to you will a response. Please provide your name, delivery address, order number and email address so we can help you quickly and easily.
7.3 How and when we will refund you? We will refund you the price you paid for the products by the method you used for payment. We will make any refunds due to you as soon as possible.
8 Our rights to end the contract with you
8.1 It is within our rights to end the contract if you don’t conform to the term and conditions.
8.1 We may end the contract for a product at any time by writing to you if you do not, respond within a reasonable time of us asking for information that is essential for us to provide the products, for example, you might need to provide, the address for delivery.
8.1.2 if you do not, within a reasonable time, allow us to deliver the products to you, the contract will end.
8.2 Refunds. If we end the contract in the situations set out in section 8, we will refund any money you have paid to us for the products we have not provided.
9 Price and payment
9.1 Where to find the price of the product. The price of the product, includes the goods and service tax (GST), a consumption tax, a value-added tax, or a tax of a similar kind. This will be included on the page where you placed the order. We ensure that the price shown on the order page is correct.
9.3 We might change the price of our products. Sometimes we need to make changes to the price of some of our products. When this happens, we’ll update the prices on our website. If you placed your order for a product before the price change, the price will be as stated on our website at the time when you placed your order.
10 Discount Codes
10.1 Sometimes we will release discount codes via our email or other marketing channels. These Codes will allow a discount to be applied to a new order at solculture.com.au. To apply a Code please enter it and remember to click “apply” were specified during the check-out process.
10.2 Additional Information Discount Codes:
10.2.1 Codes are effective for a limited period of time as specified in the relevant email or marketing communication, they cannot be used after the specified time.
10.2.2 Specific offer terms and conditions are provided with every Code provided - for specific information relevant to that Code, please refer to the email or marketing communication on which it is featured.
10.2.3 Only one Code can be applied per order.
10.2.4 Codes cannot be exchanged for cash and are non-transferable.
10.2.5 Returned items will be refunded at the discounted price paid and the discount applied between the goods respectively.
10.2.6 Codes cannot be applied towards delivery charges.
10.2.7 Orders are subject to stock availability and acceptance by us. We reserve the right to decline to accept orders where, in our practical judgement, a Code is invalid for the order being placed or is the subject of inappropriate activity.
10.3 Codes are only effective on full-priced products and cannot be applied to items already on sale.
11. Our responsibility for loss or damage suffered by you
11.1 Customers receiving our products within Australia, you may have additional rights in accordance with the Australian Consumer Law. We acknowledge you may have certain rights under the Australian Consumer Law regarding consumer guarantees (as per Division 1 of Part 3-2 of the Australian Consumer Law) and that they may apply to products supplied by us. In no part of our terms and conditions should any terms be interpreted as an attempt to exclude, restrict, or modify your rights as a customer regarding the Australian Consumer Law.
11.2 Customer receiving our products within New Zealand, you may have additional rights under the Consumer Guarantees Act 1993 (CGA). We acknowledge that you are a consumer and are not obtaining our goods via “trade” (as defined in the CGA). Nothing in our terms and conditions can exclude or limit any rights or guarantees you are entitled to under the CGA, and our terms and conditions should be read as subject to the CGA.
11.3 Acquiring our product in trade within New Zealand see some provisions of the CGA do not apply. Where you are in “trade” and acquiring our products in “trade” (where trade is defined in the CGA) in New Zealand, you acknowledge and agree that the provisions of the CGA will not apply to these terms. Nor will it apply to products provided by us under these terms and it is both reasonable and fair to be bounded by this provision outlined.
